His Highness Sheikh Hamdan bin Mohammed bin Rashid Al Maktoum, the Crown Prince of Dubai and Chairman of The Executive Council of Dubai, has introduced revisions to Executive Council Resolution No (1) of 2017, governing the regulation of railways in Dubai.
The amendments focus on the roles and responsibilities of the Roads and Transport Authority (RTA) in Dubai, specifically pertaining to the planning, design, and development of the public railway network in the city.
As per the revised resolution, the RTA is now tasked with defining the requirements, procedures, controls, standards, and specifications set forth by its Safety Regulatory Entity. The Rail Agency of the RTA and the Safety Regulatory Entity will issue certificates independently, ensuring no conflict of interest with owners, operators, contractors, or any other relevant entities.
Resolution No (53) of 2023 grants the RTA authority to cooperate and coordinate with relevant authorities in Dubai and neighboring emirates to achieve the resolution’s objectives, including seamless integration of railway systems with other transportation networks.
It also empowers the RTA to enter into contracts and agreements related to railway systems, and adopt policies, plans, and programs proposed by the Rail Agency and Safety Regulatory Entity, concerning the provisions of this resolution and any subsequent resolutions.
Moreover, the amendments highlight the functions of the RTA’s Rail Agency, including proposing policies, plans, and programs for the development and design of the public railway network. The Rail Agency will oversee their implementation after obtaining approval from the RTA’s director general. Additionally, the agency will be responsible for approving the Railway Protection Rules, General Guidelines, Planning and Design Standards Guide, and establishing criteria for the qualification and accreditation of contractors, consultants, and operators.
Resolution No (53) of 2023 also introduces changes to Article (7) and Article (10) of Executive Council Resolution No (1) of 2017, related to the establishment and operation of railway systems in Dubai. Additionally, certain provisions concerning penalties, administrative measures, judicial seizure, and complaints have been updated.
Furthermore, the resolution replaces two tables from Executive Council Resolution No (1) of 2017, involving fees for issuing certificates and providing services, as well as violations and fines associated with the Rail Agency.
The new resolution will take effect upon its publication in the Official Gazette.
